I have seen courts do terrible things to mothers. But I don't think it is due to patriarchy, as I have seen courts perform almost exactly the same way when the issue has nothing to do with women or family.
Here is a pdf of my book "Reunion: Judging the Family Court." It's mostly set in Australia. The name Reunion refers ro a "chit" scheme that I concocted to get around the finality of judges.
There are lots of problems in other courts but there is one crisis/epidemic in Family Court. Judges are routinely disregarding and covering up abuse by fathers, unjustly switching custody to fathers, allowing fathers to keep children away from mothers and bankrupting mothers. Not vice versa. That's because the underlying structure is patriarchal. Structural sexism.
I understand that husbands betray wives. I don't understand how mothers betray their children and befriend their child's abusive ex-spouse. I know too well it happens. Mothers and their children have suffered enough without that painful added layer. Children are confused enough without grandparents joining forces with ex's. Thank you, Dr. Blue.
Solidarity of women as a class fighting together is the only way we will have the power to shut down family court and replace it with a fair system that truly supports what's best for children (and their primary nurturing mothers).
